ADPUSH Service Agreement. Individual Software License
In order for your order to be processed you MUST check the box on the order form indicating you have read and understand our service agreement.
ADPUSH - Usage Agreement

Thank you for selecting ADPUSH for your banner rotation service.

GIC Inc., and Robert Costello (collectively "We") own the ADPUSH software, documentation, source code, Web site, and file structure (collectively the "Software"), and all copyrights and other rights and interest associated with these materials, including all international rights protected by applicable law and treaty. We are granting you a nonexclusive license to use the Software and services subject to the terms and conditions of this agreement. This agreement and your right to use the Software automatically terminate if you fail to comply with any provision of this agreement.

License Fee:

License fees are $12.95 per month per account. Additional accounts are $4.50 per month.

Permitted Uses. You May:

  1. Use the ADPUSH software, and the PWS Web site tools to manage banner rotations.
  2. Insert the provided HTML tags into any page(s) or Web site(s) as long as YOU are the controlling entity of said Web page or site.
  3. Add, delete, reset, remove, or modify banners in your rotation at any time.
  4. Access the ADPUSH / PWS Web site and technical support areas.

Prohibited Uses. You May Not:

  1. Sell, rent, sublicense or lease the ADPUSH Service or Software, or otherwise transfer the right of use.
  2. Decompile, disassemble or reverse engineer the Software.
  3. Attempt to cause damage to the ADPUSH servers, Web site, data files, or operating facilities.

Cautions: Some Advertisers May Object to the Use of a Third Party Rotation.

Some advertisers, ad agencies, and ad networks may prohibit the use of banner rotation systems other than their own. It is your responsibility to understand the policy of each advertiser before you add their banners into your ADPUSH rotation. UNDER NO CIRCUMSTANCES WILL GIC INC. OR ITS REPRESENTATIVES BE LIABLE FOR LOST REVENUE DUE TO THE CANCELLATION OF AN ADVERTISER, OR TERMINATION FROM ANY ADVERTISING NETWORK (SUCH AS COMMONWEALTH, EADS, PETRY, ETC.) DUE TO THE USE OF ADPUSH ON YOUR SITE.

Cautions: Service Interruptions.

The Internet is a large collection of computer networks and communication systems NOT directly controlled by GIC Inc. or its representatives. Therefore, service interruptions may happen from time to time due to conditions beyond our control. UNDER NO CIRCUMSTANCES WILL GIC INC. OR ITS REPRESENTATIVES BE LIABLE FOR LOST REVENUE DUE TO THE INTERRUPTIONS OF SERVICE. THERE WILL BE NO REFUNDS OF MONTHLY LICENSE FEE. IF THE SERVICE INTERRUPTION IS GREATER THEN 48 HOURS, GIC INC. & PWS MAY ELECT TO APPLY CREDITS TO A CUSTOMERS FUTURE BILL.

Termination of License:

Users may terminate their ADPUSH account at any time via email or in writing. We reserve the right to terminate a users account, or deny service at any time for any reason.

Warranties and Limitation of Liability.

GIC Inc. and its representatives disclaims all warranties, including but not limited to, any implied warranties of merchantability and fitness for a particular purpose. In no event will GIC Inc. or its representatives be liable for incidental, special, direct, indirect or consequential damages occurring out of or in connection with the use or performance of the Software or support services rendered by GIC Inc., even if advised of the possibility of such damages. This includes loss of advertisers, revenue, programs, profits, costs of recovering such advertisers or data, claims by other parties or loss of the use of the Software. In no case will our liability exceed the amount of the monthly license fee. This limitation of liability will apply regardless of the forms of action, whether in contract or tort, including negligence.

The warranty and limitation of liability are exclusive and in lieu of all others. No sales personnel, GIC Inc. employee, or other representative involved in the setup and/or support of the Software is authorized to make any modification to this warranty. Oral statements and/or email do not constitute warranties.

Some states do not allow the exclusion or limitation of direct, incidental or consequential damages, so the above limitation may not apply to you.
